Abstract: The article explores the complications of the U.S. public domain amid the growth of digital technology. It discusses the ability of the general public to step outside of the public-unfriendly copyright regime by using public domain in music, art and texts in digital mashups. The right of government agencies to copyrights created by nongovernmental employees under contracts or grants is noted. The implementation of the Copyright Term Extension Act in the public domain is also explained.
