| Abstract (English): | Introduction: This research establishes a relationship between the conceptual and historical construction of the human right to development and the theory of unnamed rights (derechos innominados) in Colombia, insofar as the latter allows for the recognition of this right within the national legal framework. Objective: The study seeks to define the contents of the human right to development, understanding it within the Colombian legal system. Methodology: The research is grounded in a qualitative approach based on jurisprudential and doctrinal analysis regarding the right to development and its connection to fundamental rights, including those unnamed rights that have been recognized through jurisprudence. Results: The findings identify multiple judicial decisions in which essential aspects of this right have been recognized and protected. Conclusions: It is highlighted that the human right to development constitutes a fundamental mechanism within the category of emerging rights, ensuring conditions that promote well-being, dignity, and progress, both individually and collectively, within society. | Abstract (Spanish): | Introducción: Esta investigación establece una relación entre la construcción conceptual e histórica del derecho humano al desarrollo con la teoría de los derechos innominados en Colombia, en la medida en que esta última permite reconocer dicho derecho dentro del marco jurídico interno. Objetivo: Busca delimitar los contenidos del derecho humano al desarrollo, entendiéndolo dentro del ordenamiento jurídico colombiano Metodología: La investigación se sustenta en un enfoque cualitativo, basado en el análisis jurisprudencial y doctrinal sobre el derecho al desarrollo y su vinculación con los derechos fundamentales, incluidos aquellos de carácter innominado que han sido reconocidos por la jurisprudencia. Resultados: Dentro de los hallazgos se identificaron múltiples decisiones judiciales en las cuales se ha reconocido y garantizado la protección de aspectos esenciales de este derecho. Conclusiones: Se destaca que el derecho humano al desarrollo constituye un mecanismo fundamental dentro de la categoría de los nuevos derechos para asegurar condiciones que favorezcan el bienestar, la dignidad y el progreso, tanto individual como colectivo en la sociedad. | Abstract (Portuguese): | Introdução: Esta pesquisa estabelece uma relação entre a construção conceitual e histórica do direito humano ao desenvolvimento e a teoria dos direitos inominados na Colômbia, na medida em que esta última permite o reconhecimento desse direito no âmbito jurídico interno. Objetivo: Busca delimitar os conteúdos do direito humano ao desenvolvimento, compreendendo-o dentro do ordenamento jurídico colombiano. Metodologia: A pesquisa baseia-se em uma abordagem qualitativa, fundamentada na análise jurisprudencial e doutrinária sobre o direito ao desenvolvimento e sua vinculação com os direitos fundamentais, incluindo aqueles de caráter inominado que têm sido reconhecidos pela jurisprudência. Resultados: Entre os achados, identificaram-se múltiplas decisões judiciais nas quais foram reconhecidos e garantidos aspectos essenciais desse direito.
